The Firm
Turken, Heath and McCauley, LLP, is dedicated to providing quality legal representation to our clients in a cost-efficient manner. In addition to the firm’s litigation services, and in keeping with our mission to protect those who protect others, we proudly represent first responders and other survivors of the devastation of September 11, 2001, through the good work of our 9/11 Practice, obtaining just compensation from the September 11th Victim Compensation Fund.
Our litigation partners and associates have spent the vast majority of their legal careers zealously defending claims of medical malpractice, ordinary negligence and other tortious conduct that allegedly caused plaintiffs to sustain serious physical injuries, disability or death. We have most often represented hospitals, individual physicians and medical practices, nurses and nurse-practitioners, nursing homes and rehabilitation centers, nonprofit social and mental health service agencies, building owners, and industrial and pharmaceutical plants in high exposure litigation. Our adversaries know that we are ready, willing and able to defend any case at trial, and will not hesitate to do so. Our clients know that we have brought scores of cases to their quiet and final conclusions without any payment having to be made to the plaintiffs or their attorneys, and without having to try the case.
We have successfully defended hospitals, industry and the professions in thousands of medical, dental, podiatric and nursing malpractice cases, in addition to general liability, toxic tort, environmental, property damage and construction-related actions, in which millions of dollars in damages have typically been claimed by plaintiffs in cases filed in the many state and local courts located in the five boroughs of New York City, the counties of Westchester, Putnam, Dutchess, Rockland, Orange, Nassau and Suffolk, and in the Southern and Eastern federal district courts.
We have also successfully drafted and argued numerous appeals, both as appellant and respondent (or appellee) in the First and Second Departments of the NYS Appellate Division and the U.S. Second Circuit Court of Appeals.
Our mission is to provide our clients with effective, economically-sensitive legal services, including thoughtful advice and counseling for the reduction of financial risk and exposure, creative representation including the use of alternative dispute resolution, and thorough preparation and mission-driven focus in defense of legal actions and as advocates at trial. Our main purpose and goal is to win every case in a manner and within a budget approved by the client, always prepared to change course at a moment’s notice and seek the most favorable out-of-court resolution when and if the client prefers. We are able and experienced negotiators, haggling with the toughest plaintiffs’ attorneys in New York City and surrounding counties on a daily basis, commonly obtaining settlements for less than the amount authorized by the client.
The firm’s partners, of counsels, associates and paralegal staff are responsive to its clients’ real-world business needs and requirements in terms of strategic planning, reporting, budgeting, auditing, adherence to proprietary billing practices, and website/portal interfacing.
Our policy is to get the job done right, as efficiently as possible. Our practice is to be good, solid, dependable defense lawyers, appreciated by our clients and respected by our adversaries for our knowledge, ability and tenacity in the defense of every case and client.
